[Subj + be + seen] is a passive structure which may or may not have to require an agent. When you use [by] in a passive structure, the sentence has an agent who carries out the act.
The murder suspect was seen running out of the house under the cover of darkness (by the neighbors). In this case, the neighbors is the collective agent that may or may not be necessary.
