uh... ur wrong.
In order to conclude that the German keeps the fish, you must ASSUME that the fifth pet is the fish. Since the word "fish" doesn't appear anywhere in the facts/hints except the question, you CANNOT assume that the fifth pet is the fish. Einstein was right, barely anyone refrained from making this assumption.

the whole point to Einstein's way of thinking is NOT to make any ASSUMPTIONS.

Oh for heaven's sake! These types of puzzles work like this all the time. I've been doing logic puzzles since I was a child. They do NOT list all the names, all of the colors, all of the drinks, etc., etc. You are supposed to use reasoning to figure it out, not say "The German in the green house has a pet, but I can't assume it's a fish." I have no reason to think Einstein even knew about this puzzle, let alone made claims that too many people make an assumption about fish!
