Scenario: Paul, the people in Best Buy are not commissioned right?

And then I say:

1. Because I saw an advertisement yesterday on TV saying that the people in that company were not commissioned.

2. Because I saw an advertisement yesterday on TV saying that the people in that company are not commissioned. 

Which one should I use and why? #1 or #2?
