When do the banks open?

The answer can be:     I don't know when the banks are open.

Is the answer ok?   

My doubt is why do I use infinitive after to be in this sentence? 

Is there some rule about  that situation  I don't know?

1- when do the banks open? I don't know when the banks open.

2- when are the banks open? I don't know when the banks are open.

both seems grammatically correct. in 1 "open" is a verb but in 2 it's an adjective. a native can tell whether there is a difference in meaning.

If you want to use 'open' as a verb, say 'I don't know when the banks open'.
