In the above quotation, which does the "who" refer to? is it ken gibson or "someone representing"

Think about it: Ken Gibson was most probably familiar with the case, because he was involved in it, he was affected by it. There's no point in underlining his knowledge of the case.

It's  "someone representing him."

 Most probably yes, but show more context ... perhaps:

 "It's him who eats the food [that produces the damage]"

and perhaps more formal/correct, because you need a subject form here: 

 "It's he who eats the food [that produces the damage]"
