Could you please explain the difference between contract and agreement? Is there actually any difference between these two terms in American/British legal system? For example in the text below the terms are expressly distinguished.

ANSWER

CONTRACT A contract is the legally binding agreement made between two or more parties. This definition is subjected to questions in that in the majority of standard form of contracts there are not negotiations between the parties in the sense that the results cannot be said to be agreements .Also contract is a promise or set of promises for the breach of which the law gives remedy, or the performance of which the law in some way recognizes as duty.

THEREFORE
A contract must be an agreement however to quality as a contract an agreement must meet a number of tests.the main test you should look for is whether or not the agreement is enforceable by law .

note that all agreements are enforceable by law:

a contract has to be enforced in court whereas an agreement is not enforced in court.
A contract is an agreement entered into voluntarily by two parties or more with the intention of creating a legal obligation, which may have elements in writing, though contracts can be made orally. The remedy for breach of contract can be "damages" or compensation of money.

Contract is legally binding. Not all agreements are legally binding. Example Every students was asked if they agree to go to Enchanted Kingdom for the next school trip and everyone agreed to come but one of them did not attend in this case it doesnt make that student who did not attend ,legally liable for not attending the school trip. That's why not all agreements are contracts.
