It's based on necessary or unnecessary choices. If (he, she, it) *needs [necessary]* to go to the bathroom, then the sentence would be something like: He has to go to the bathroom. If there is *no need [not necessary] then it becomes: He doesn't have to go to the bathroom. Finally, if it's asking or referencing a question, then it becomes "have".
