Is the following sentence correct? Please let me know of your suggestions, if any.

Fishing is not allowed here. Anyone caught fishing here would be fined $100, and in certain cases would be jailed for five days.

I think it is ok except that "would" should be changed to "will" in both occurences.

What is the difference in meaning between the following and the above sentence?

Fishing is not allowed here. Anyone caught while fishing here will be fined $100, and in certain cases will be jailed for five days.

But why?
These are different structures from the grammar viewpoint, but equal when it comes to meaning.

A similar situation:
1. This work was done by me
2. I did this work

Grammar: passive vs. active
Meaning: same
Teachers: We supply a list of EFL job vacancies
Fishing is not allowed here. Anyone caught while fishing here will be fined $100, and in certain cases will be jailed for five days.

'Anyone caught fishing ... ' is very clear, so why do you want to introduce 'while'?

When I read Jackson's sentence, a word came to my mind, what if you use "prosecuted" here? It seems to be a warning, and, it should be formal, shouldn't it? ..but, I don't know how it is used. Can it be,

Fishing is forbidden here. Anyone caught fishing will be prosecuted.

?

It's correct to use 'prosecuted' but then there is no mention about the fine. How much will the fine be? If the amount is stated it serves at deterrent.
