Oil and gas were not made at the place where they can be/are found today, but considerably deeper. Oil and gas got through the cracks from the depth closer to the surface and stopped in perforated rocks (deposits) below which there is a thick imprevious layer (marl, clay, shale). The process/es of oil creation takes place even today. Sites of today's oil deposits are located on the places where seas had flooded the continets (Iraq, UEE; Kuwait, Libya, Algires etc)as well as under today's seas (Northern Sea, Kaspian Sea, Atlantic Ocean and Pacific Ocean).

The hard, impervious rocks form a cap ABOVE the oil deposits and so stop it escaping and rising up to the surface
