Why does it matter to you? It's really not important whether "being" is a gerund or a present participle. The important thing is that it's a verb.

They could have -- in fact they should have if they wanted the sentence to be grammatically correct!

The ungrammaticality could easily have been avoided by using a semicolon or a dash instead of a full stop.
